Our DUI practice also covers underage DUI, boating under the influence, and prescription drug DUI matters.

Georgia Penalties for Multiple DUI Convictions

Georgia uses a rolling 10-year criminal lookback period to determine whether a DUI is treated as a repeat offense. The period runs from the arrest dates associated with earlier convictions to the date of the new arrest. Because arrest dates control this calculation, the conviction date alone doesn’t establish whether an earlier case qualifies.

First and second DUI convictions are misdemeanors under Georgia law. A second conviction within 10 years carries a fine of $600 to $1,000. Other sentencing requirements depend on the offense level and circumstances, so the complete court record must be reviewed before the possible consequences can be assessed.

Third DUI Within 10 Years

A third DUI conviction within the criminal lookback period is classified as a high and aggravated misdemeanor. This classification exposes the accused person to more serious treatment under Georgia law than a first or second offense. We examine whether each conviction alleged by the prosecution falls within the applicable period.

Fourth or Subsequent DUI

A fourth DUI offense within the rolling 10-year lookback period is a felony. A conviction carries one to five years in prison and a fine between $1,000 and $5,000. The dates, records, and validity of the earlier cases must be verified before they can support that allegation.

Repeat-offense status isn’t the only reason a DUI may become a felony. A DUI involving serious injury or death may also be charged as one. In addition, a driver declared a habitual violator after three qualifying DUI convictions within five years may face felony consequences.

The 30-Day Driver’s-License Deadline

A DUI arrest starts two separate proceedings: the criminal prosecution and the administrative driver’s-license process. The criminal case addresses guilt and sentencing through the courts. A license suspension concerns driving privileges and can proceed independently of the criminal charge.

A driver has 30 calendar days after arrest to request an administrative license hearing with the Georgia Office of State Administrative Hearings. Missing that deadline results in automatic license suspension regardless of the eventual outcome in the criminal case. Waiting for an arraignment or another court date doesn’t pause this timeline.

Depending on the circumstances, the response may involve requesting a hearing or installing an ignition interlock device, which requires a breath sample before a vehicle can start. The appropriate choice and requirements should be evaluated using the arrest documents and the driver’s history. We address this separate process when reviewing the immediate steps after an arrest.

Reviewing Earlier Convictions in a Repeat DUI Case

Multiple DUI defense requires more than counting entries on a criminal history. We review the pending allegations alongside the court records supporting every earlier conviction cited by the prosecution. This analysis considers the arrest dates and whether each case is legally valid for repeat-offender treatment.

The validity of an earlier conviction can affect the classification of the pending charge. If it doesn’t qualify under the applicable lookback rule, it may not support the felony count alleged by the prosecution. In some circumstances, excluding a nonqualifying conviction from the calculation may reduce a felony charge to a misdemeanor, although the result depends on the record and facts of the case.

We also examine the evidence from the arrest at issue and build a strategy around the individual circumstances. Each repeat DUI allegation presents distinct factual and procedural questions. The defense must account for both the present evidence and the legal foundation of the claimed earlier offenses.

Courts Handling Repeat DUI Charges in Forsyth County

The classification of a repeat DUI charge helps determine which local court has jurisdiction. Forsyth County State Court handles misdemeanor criminal cases, including misdemeanor DUI and traffic offenses. Forsyth County Superior Court has exclusive jurisdiction over felony criminal matters, including qualifying fourth-or-subsequent DUI charges.

Cases originating in Cumming Municipal Court may be bound over to State or Superior Court when felony charges apply or a jury trial is requested. A bound-over case is transferred to a court with authority to handle the charge or trial request. Identifying the venue clarifies the procedures and court dates that follow.

Forsyth County Accountability Courts also include a DUI Court program for multiple DUI offenders and people accused of driving with a high blood alcohol concentration. Placement isn’t automatic. Eligibility and participation depend on the program’s requirements and the circumstances of the case.
