When the Arresting Officer Is the Problem
What You Need to Know About the Arresting Officer
Most people assume that because a police officer made an arrest, the arrest was valid. Most people are wrong.
Officers make mistakes. Officers cut procedural corners. And some officers have a documented history of conduct that makes everything they touch legally vulnerable — including your arrest.
At The Epps Law Group, we do not just review what happened on the night of your arrest. We review who made the arrest.

What We Look For
Every officer who testifies in a criminal case brings their entire professional history into that courtroom with them — whether the prosecution likes it or not. We investigate:
- Prior disciplinary records. Officers who have been terminated, suspended, or disciplined for dishonesty or misconduct at any agency carry that record forward. Under Georgia and federal law, that history is often admissible to challenge their credibility in court.
- POST certification history. Georgia's Peace Officer Standards and Training Council tracks every officer's certification, decertification, and reinstatement history. A revocation for cause is a powerful impeachment tool.
- Prior judicial findings. If a court has previously suppressed evidence obtained by a particular officer, or ruled against their testimony in a suppression hearing, that matters. We track it.
- Pattern conduct. An officer who has generated multiple complaints, multiple suppression motions, or multiple cases with similar procedural problems is not having bad luck. That is a pattern — and patterns are persuasive in front of a judge.
Why This Matters for Your Case
Kyle Epps spent fourteen years in law enforcement. He knows what proper police procedure looks like, and he knows what it looks like when corners are being cut. He has the background, the training, and the investigative tools to examine the conduct of the officer who arrested you with the same scrutiny that the officer applied to you.
This is not a strategy that every defense attorney is equipped to execute. Most attorneys see an arrest report. Kyle Epps sees an arrest report and knows exactly what questions to ask about the officer who wrote it.
This Is Not an Attack on Law Enforcement
Kyle Epps was law enforcement. He has deep respect for the officers who do this job with integrity every day. This page exists precisely because those officers deserve a profession not tainted by the ones who don't.
Holding officers accountable through the legal system when they overstep is not anti-police. It is the system working exactly as it was designed to work.
